New Opportunity for Families of Foreign Workers



Starting January 30, 2023, it is now possible for the families of certain foreign workers to apply for an open work permit to immigrate and work in Canada. However, there are some exceptions to this new measure. Specifically, it is indicated that spouses and dependent children of workers in NOC 4 or 5 category occupations in the low-wage stream, the Seasonal Agricultural Worker Program, and/or the agricultural stream of the Temporary Foreign Worker Program are not eligible at this time.


Family members wishing to benefit from these new measures must meet the following criteria:


  1. You meet the general eligibility requirements for a work permit.

  2. You have made an application on January 30, 2023, or after.

  3. You are in a genuine relationship with the person who makes you eligible for this open work permit and are one of the following:

    1. The spouse or common-law partner of the principal foreign applicant;

    2. The dependent child of the spouse or principal foreign applicant;

    3. A dependent child cannot be the principal foreign applicant.

    4. The dependent child of a dependent child (grandchild of a principal foreign applicant or their spouse).

  4. If you are in Canada, you are in one of the following situations:

    1. You have a valid temporary resident status;

    2. You have applied to extend your status before it expired (maintained status).

    3. You are eligible for the restoration of your status.
